Terms & Conditions
These terms explain the rules for using Dinedex, a restaurant discovery and food diary service operated by individuals based in Australia. “We”, “us” and “our” mean the people operating Dinedex. Dinedex is our web app and brand name, not an incorporated company. Contact us at support@dinedex.app.
1 Your account and agreement
You must be at least 18 and legally able to enter this agreement to create or use an account. You must confirm that you are 18 or older when signing up or renewing your agreements. Parental permission does not allow an under-18 account.
When creating an account, you agree to these terms and acknowledge the Privacy Policy. Newsletter marketing is optional and is not a condition of having an account. Acknowledging the Privacy Policy does not give blanket consent for unrelated uses of your information.
Provide accurate account details, keep your sign-in information secure and tell us if you suspect unauthorised access. Use the sign-in method associated with your account. You are responsible for activity you authorise through it. Google sign-in also involves your relationship with Google under its own terms.
2 The service and restaurant information
Dinedex lets you discover restaurants, save places and lists, record visits and reviews, and interact with other users. Our service is currently directed at the Australian market, with a public catalogue of Australian restaurants. English and Spanish are interface languages. We do not currently provide restaurant bookings or payments, or display paid third-party advertising within the web app. Section 3 explains the separate permissions to use public content for promotion and commercial purposes.
Restaurant information may come from public sources, submissions and user contributions. Information and reviews may be incomplete, outdated or mistaken. Confirm opening hours, prices, accessibility, ingredients and allergy information directly with the restaurant. Dinedex does not provide medical or dietary safety advice or guarantee a restaurant's safety or quality. We are not a party to your transaction with a restaurant.
Restaurant suggestions must concern restaurants in Australia and are reviewed before publication.
3 Your content and permissions
You retain ownership of the reviews, photos, comments, lists and other material you contribute (your content). You must own that content or have the permissions needed to submit it and grant the rights described here, including any necessary permissions concerning people depicted in it. Reviews must reflect your own experience and honest opinion. Do not fabricate experiences, manipulate ratings or hide a relevant incentive or connection that would make a review misleading.
By submitting content, you give the Dinedex operators a non-exclusive, worldwide, royalty-free licence to store, reproduce, process, edit, resize, crop, format, translate, adapt, combine, distribute and display it as needed to operate, maintain and improve the web app, in accordance with its visibility settings. This includes preparing different formats and derivative works for those purposes and allowing our service providers to perform that work.
For content you publish publicly on Dinedex, you also grant the Dinedex operators a non-exclusive, worldwide, perpetual, royalty-free, transferable and sublicensable licence to reproduce, edit, adapt, translate, combine, create derivative works from, publish, distribute, publicly display, perform and otherwise use that content for commercial purposes connected with Dinedex and its business. These purposes include marketing and promoting Dinedex, its community and featured restaurants, and incorporating content into advertisements, social-media posts, promotional emails, websites, publications and other media, including third-party channels. We may receive commercial benefit from these uses without paying you royalties or other compensation, unless we separately agree otherwise.
We may sublicense these rights to service providers, marketing agencies, publishers, social-media platforms, restaurants and other commercial partners for the purposes described above, including use on their own channels. We may transfer the licence with the relevant Dinedex business or assets. Sublicences remain subject to the scope of this licence and applicable law. The public username, displayed name and avatar associated with a contribution may accompany it for attribution and promotion, subject to the Privacy Policy and any additional permission required by law.
The public-content licence has no fixed end date and survives removal of the content, changes to its visibility and closure of your account. Deletion from your account does not itself revoke that licence. Subject to applicable law and the Privacy Policy, we and our licensees may continue using copies lawfully retained for the licensed purposes, including in existing or later promotional materials. This does not prevent you from making a privacy, correction or removal request, or authorise retention of personal information for longer than law permits.
Content kept private through the available controls, unpublished drafts, account contact details and private support correspondence are outside the promotional and commercial licence. The service-operation licence for private content lasts only while needed to provide the service, complete deletion, maintain necessary backups or meet lawful legal or security requirements. A contribution previously published publicly remains subject to the public-content licence, but we will respect any applicable legal requirement to stop using or remove it.
These licences do not transfer your ownership or prevent you from using or licensing your own content elsewhere. They permit the uses described without a separate copyright permission for each use. They do not waive moral rights, permit misleading edits or false endorsements, or replace any separate consent required by privacy or other applicable law. Choosing whether to receive marketing emails remains separate from the content licence.
Your public contributions and profile details can be seen and copied by others. A personal food diary entry is not necessarily private. Read the Privacy Policy and the available visibility settings before posting information you want to keep confidential. For a concern about use of your content, contact support@dinedex.app.
4 Responsible use and reporting
Do not post unlawful, deceptive, defamatory, discriminatory, threatening or harassing material, spam or private information about another person without an appropriate basis. Do not impersonate others, compromise accounts, evade access controls, manipulate social features, interfere with the service or collect personal information unlawfully. Respect intellectual property and privacy rights.
To report a review, privacy concern, copyright issue or other suspected misuse, email support@dinedex.app. Include a link or enough information to locate the content, explain the concern and provide relevant supporting details. Do not send unnecessary sensitive information. Users and restaurants can use this reporting route.
We may remove content or restrict an account where reasonably necessary to address a breach, protect people or the service, or comply with law. Where appropriate, we will explain the decision and you can ask us to review it. Urgent security or legal circumstances may require us to act first. A report does not guarantee removal, and we do not promise to review every contribution before publication.
5 Intellectual property and other services
The Dinedex operators and their licensors retain all rights, title and interest in the web app and materials developed or provided by or on behalf of Dinedex, except for user content and other material owned by third parties. These materials include text, graphics, logos, designs, icons, images, sound and video recordings, pricing presentations, downloads and software, where provided. Protected rights may include copyright, trade marks, design rights, patent rights and rights in domain names, to the extent those rights exist and are owned or licensed by us. This does not claim ownership of another person's content, unprotected facts or rights we do not hold.
Subject to these terms, we give you a limited, non-exclusive, non-transferable permission to access and use the web app and its materials through the functions we provide. This does not transfer ownership or authorise you to copy, modify, distribute, sell, sublicense or commercially exploit our materials or use our branding outside that permission without the relevant rights holder's consent. All intellectual property rights owned by or licensed to us that are not expressly granted to you are reserved. Rights and exceptions provided by law and applicable third-party or open-source licences remain unaffected. Your own content is governed by section 3.
The service may link to restaurant websites or other external services. Those services have their own terms and privacy practices. Their inclusion does not guarantee their accuracy, availability or quality. These terms do not remove any responsibility we have under applicable law.
6 Emails and preferences
We may send confirmation, recovery, security and essential service messages. You can separately choose to receive newsletter marketing. You can withdraw that choice in Settings, through the unsubscribe method in a marketing message or by contacting support@dinedex.app, without losing your account. If we send marketing, we respect your current choice and provide an unsubscribe method.
7 Changes and closing an account
Maintenance, faults and third-party services can interrupt availability. Features may change. We will give reasonable notice of material changes where practical, including changes to these terms. Where renewed agreement is required, we will ask for it rather than treating silence as consent. Changes do not remove rights that have already arisen.
You can stop using Dinedex at any time. Closing your account is a separate action from signing out or stopping use. Use the account-deletion controls, which require recent sign-in and confirmation, or contact support@dinedex.app for help. If you do not wish to accept updated terms, you can stop using the account and request its closure.
Account-data removal and stored-file removal are separate steps. Failed file removals are retried; some photo links can remain accessible until removal succeeds. Relevant information may need to remain for necessary legal, security or dispute-related purposes. Provider backups and copies made by others may remain outside the immediate deletion process. The public-content licence in section 3 survives deletion and account closure; separately retained promotional or licensed copies are subject to the Privacy Policy and applicable law. See the Privacy Policy for retention rules and how to make a request.
8 Your legal rights and disputes
Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees and other mandatory consumer protections. We do not require you to waive privacy rights or accept liability exclusions prohibited by law. Responsibility for a loss depends on the applicable law and circumstances.
Contact support@dinedex.app so we can try to resolve a concern.
These terms are governed by the laws applying in Victoria, Australia. Subject to any rights you have under applicable law that cannot be excluded or restricted by agreement, you and the Dinedex operators submit to the exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia, and the courts hearing appeals from them. This clause does not limit any non-excludable right to bring a claim in another competent court or tribunal, or your right to contact a regulator.
If part of these terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. The Privacy Policy explains our information-handling practices; any consent needed for an additional use must be obtained separately.
